Citation
(1) These By-laws may be cited at the Town Council of Taveta (Kenya Power & Lighting Co. Ltd Levy) by laws and shall apply to the area within the Jurisdiction of the Town Council of Taveta.
Interpretation
(2) In these By-laws unless the context otherwise requires
‘Charges’ means payment or fee imposed by the Town ‘Council of Taveta hereunder.
‘Council’ means the Town Council of Taveta
‘Company” means the Kenya Power & Lighting Co. Ltd.
‘Poles’ means the wooden or metal structures erected by the company within the Town council of Taveta on which transmission lines for power are amounted.
Imposition of charges
The council hereby imposes a charge of Kenya shillings one hundred and fifty only (Ksh 150/=) per pole per year situated within the jurisdiction of the Town Council of Taveta
(3) The council hereby imposes a charge of Kenya shillings one hundred and fifty only (150) per pole per year against every pole and 2000 per transformer per year situated within the jurisdiction of the town council of Taveta.
(4) The company shall immediately upon the approval of these By-laws by the Minister for Local government provide an audit to the Town Council of Taveta of all Poles and transformers situated within the jurisdiction of the Town council of Taveta and such audit to indicate the number of poles and transformers and facilitate a joint consensus of all electric poles and transformers within the Town Council.
(5) The company shall keep the Council informed of all newly installed poles from time to time to enable the Council to update its record

(6) The company shall remit to the council the sum of Kenya shillings one hundred and fifth (ksh.150) per pole per year being the said charge for every pole and Kenya shilling two hundred (200) per transformer per year situated within the jurisdiction of the Town Council of Taveta not later than 31st day of March every succeeding year.
Telkom to keep Books of Account
(7) At all times the company shall keep proper and up to date details of all monies payable by it and provide the same to the council on the conclusion of every month.
Telkom to keep Records of poles
(8) At all times the company shall keep proper and up to date records of all poles and transformers currently in line and situated within the jurisdiction of the Town Council of Taveta.
Inspection of records
(9) The company shall permit the council’s employees or duly appointed agents to inspect the said books of accounts and records for the purposes of reconciling its own books and records and for ensuring compliance with these By-laws.
Penalty for Breach
(10) In the event that the company shall fail to remit monies due in accordance with section 6 hereof a penalty shall be imposed there on at the safe of three per cent per annum (compounded) from the date of the default and the council shall be a liberty. To recover such monies plus interest of the said sums by legal action.
