1. Citation
(1) These By-laws may be cited as the Town Council of Telkom levy By-laws and shall apply to the area of Town Council of Taveta 2008.
Interpretation
(2) In these By-laws unless the context otherwise requires:-
‘Charges’ means payment or fee imposed by the Town Council of Taveta as provided hereunder.
‘Council’ means the Town Council of Taveta
‘Company’ means the Telkom (K) Ltd.
‘Poles’ means the wooden or metal structures erected by the company within the Town council of Taveta on which transmission lines in communication are amounted.
(3) The council hereby imposes a charge of Kenya shillings one hundred only (Ksh.100) per pole per year against every pole and 200/= per telephone booth per year situated within the Town Council of Taveta.
(4) The company shall immediately upon the approval of these By-laws by the Minister for Local Government provide an audit to the Town Council of Taveta of al poles situated within the Town council of Taveta and facilitate a Joint consensus of all electric powers within the municipal council to be undertaken by the council and the corporation.
(5) The company shall keep the council informed of all newly installed poles from time to time to enable the council to update its records.
(6) The company shall remit to the council the sum of Kenya shillings one hundred (Ksh 100) per pole per year being the said charge for every pole and Kenya shilling 200 per telephone booth per year situated within town council of Taveta not later tan 31st day of March every succeeding year.
(7) At all times shall company keep proper and up to date books of accounted setting out details of all monies payable by it and provide the same to the council on the conclusion of every month.
(8) At all times the company shall keep proper and up to date records of all poles currently in line and situated within the Town Council of Taveta.
(9) The company shall permit the council’s employees or duly appointed agents to inspect the said books of accounts and records for the purpose of reconciling its own books and records and for ensuring the better performance of these By-laws.
(10) In the event that the company shall fail to remit monies due in accordance with section 6 hereof a penalty shall be imposed there on at the safe of three percent (compounded monthly) annum from the date of the default and the council shall be at liberty to recover such monies plus interest of the said by legal action.
